Unfortunate ATV Accident

Status: Closed

On September 1, 2015 the Board of Directors advised that Redstone Lake Cottagers Association (RLCA) and others had been sued by the family of a young man who died in an ATV accident which occurred at the north end of Redstone Lake in the summer of 2012.   A defence to this law suit was prepared on behalf of RLCA by counsel appointed by our insurer, Aviva Canada Inc., denying any liability on the part of RLCA. 

The law suit has now been dismissed without costs against RLCA.  We have expressed our gratitude to our insurer Aviva Canada Inc., to our agent Cade Insurance and to counsel appointed by the insurance company, for looking after the defence to and dismissal of this law suit, all without cost to RLCA.

In the summer of 2012 an unfortunate accident involving an ATV which occurred on private property at the north end of Redstone Lake resulted in the tragic loss of life of a young man. We can only imagine the pain, suffering and loss experienced by that young man's family and our sincere sympathy goes out to them.

As you may have heard, the family of the young man has commenced a law suit against a number of people and corporations alleging those people or corporations are responsible for the death of their son and liable to pay compensation for this tremendous loss the family has suffered. Redstone Lake Cottagers Association (“RLCA”) has been added as a defendant in that lawsuit. Aviva Canada (our insurers), will be vigorously defending itself against the allegations made and the claim for compensation. Our advisors are of the view that there is no merit in the claim against RLCA which has no connection to the lands or roads or ATV on which the accident in question occurred. We will keep you advised as the insurer moves to have this action dismissed with costs awarded for RLCA.
